California Code of Regulations Title 10 - Investment Chapter 5 - Insurance Commissioner Subchapter 1 - Production Insurance Article 2

Bail Bond Agency Employers are Responsible for the Conduct of their Employees - "I didn't know," may no longer be a safety net.

Section 2063.1 Employer Supervision; Disciplinary Action

“An employing bail agent or permittee shall exercise a reasonable degree of supervision over his employees and make a reasonable effort to keep informed of their acts as his employees. Failure of the employer to exercise such supervision resulting in the violation of law or these regulations by the employee may result in disciplinary action against the employer.”

The extreme importance of proper Continuing Bail Education in California is not to be overlooked, and perhaps it would be worth employing bail agents to consider alternative sources of timely and current bail education with respect to the continuing bail education of their employees, but why?

Plainly stated, an employing bail agent may be disciplined for failing to keep informed of the acts of his or her employees; consequently and in light of current events, supervisors may very well be held accountable for the actions or lack thereof when it comes to what their employees are doing in a bail office; accordingly, “I didn’t know” may no longer work.

“Hey Rex,

This is Chuck from the Salida—Modesto class earlier this month.

I just wanted to let you know that I was contracted to hunt a $50,000 skip that fled to my island from Washington State.

The recovery agent called me, and, after we talked for a couple minutes, I told him I just returned from California where I took your course.

Mentioning you and Bailspeak earned me instant recognition as a working, knowledgeable professional, and we talked for approximately 45 minutes.

Your name travels wide and is well respected.  I'm sure you already know that, but I just thought that I'd pass this on.

Have a good day Rex and thank you again, Sir.”
